The Public Health Institute (PHI) is hiring a Contracts and Procurement Manager. The Contracts and Procurement Manager provides leadership, strategy, and technical expertise for the procurement, development and negotiation of agreements, and purchasing of all out-going third-party goods and services related to work funded at PHI. The Contracts and Procurement Manager Position manages the Agreements Team. The agreements team is responsible for the compliance review and efficient development and processing of procurement, development, negotiation, and purchasing of various agreement types - subawards, subcontracts, consultant agreements, memorandum of understanding, business associate agreements, vendor agreements, and more.

Essential Duties & Responsibilities

• Provides training and direction to staff on the implementation of agreement and procurement guidelines and policies.

• Holds responsibility for the development in accordance with templates, negotiation, and execution of a full contracts management process including the creation of agreements in accordance with standard terms, conditions, and templates; codification of contracting standards; negotiation guidelines and establishment of business processes.

• Responsible for the creation, negotiation, and administration of a mixed portfolio of subawards, subcontracts, awards, consultant and other vendor agreements.

• Creates and implements processes and procedures that enable and enhance monitoring, tracking, and dissemination of regulatory and compliance issues as required by PHI funding awards.

• Collaborates with program personnel, Grants and Contracts Specialists, and outside-party representatives throughout the procurement, negotiation, and purchasing life cycle.

• Identifies appropriate procurement mechanisms, contractual language and instruments for all agreements while ensuring compliance with PHI policies and procedures and funder guidelines, rules, regulations, etc.

• Evaluates subcontractor and subaward proposals (terms/conditions/pricing) in order to negotiation and develop solutions that meet program needs. Ensures compliance with prime grant, contract and agreement requirements.

• Reviews and executes funder related policies and procedures for subcontract management. Implements and manages subrecipient monitoring program for PHI.

• Identifies, mitigates, and resolves complex subcontractor issues related to risk assessment.

• Serves as an expert and first line resource for all complex contract-related issues. Advises Central and Program staff on the appropriate contracting vehicles and language.

• Responsible for risk review and annual certification/risk review of subaward transactions per PHI’s subrecipient monitoring policy.

• Perform other duties as assigned.

 

Minimum Qualifications

• Eight years progressive experience in contract and grant administration, subaward development and management, or relevant and equivalent experience.

• Advanced knowledge and understanding of foundational contracting principles, terms, and conditions.

• Experience in providing leadership, vision, technical and project management-related skills in setting priorities, working with cross-functional teams, and meeting project timeline goals.

• Experience with managing people and providing professional development to team members.

• Experience working within the contract administration process for agreements governed by federal, state, and local regulations including OMB Circulars, Agency Grants Policy Statements, Federal Acquisition Regulation, state acquisition standards, or cost-accounting standards.

• Experience applying best practices regarding contract development, negotiation, processes and the use of technology to support process flow.

• Strong acumen in working with contractual templates and terms, including a strong foundation with analyzing and understanding complex legal and contractual terms and conditions.

• Advanced written, verbal and interpersonal communications; advanced ability to deal with broad and diverse constituencies with advanced customer service orientation and skills.

• Ability to use independent judgment and strategic thinking skills in solving problems.

• Advanced organizational, presentation, negotiation and listening skills with an excellent ability in spotting potential issues, developing potential solutions and working across multiple individuals to find a resolution.

• Comprehensive knowledge of Microsoft office applications and comfort in learning and working across database and project management systems.

 

Desired Qualifications

• Master’s in Public Administration or Public Health, Business Administration or related field (or the equivalent experience) is desired.

• CRA or Paralegal Certificate is preferred.

• This is a full-time (40 hours per week) position based in Oakland, CA.
